Service Agreement & Liability Waiver

By applying for reduced-cost services, using our platform, or making any payment, you agree to the following legally binding terms:


1. Scope of Service

Compassionate Reprieve (“we,” “us,” “our”) is a nonprofit organization that facilitates access to funeral streaming services for incarcerated individuals.

  • We do not operate or directly control the streaming services. Instead, we coordinate with third-party service providers, including VUERZ, to facilitate streaming.
  • We do not guarantee approval from correctional facilities. All approvals are at the discretion of the facility, and policies may change at any time.
  • We do not guarantee uninterrupted service, as streaming availability depends on the correctional facility, third-party vendors, and internet connectivity.
  • All services will be performed by VUERZ or another third-party provider, and Compassionate Reprieve is not responsible for any actions, errors, omissions, or failures of these service providers.

2. Minimum Service Fee & Sliding Scale Pricing

  • All applicants must pay a minimum non-refundable processing fee of $25, regardless of income level.
  • Families that qualify for the lowest pricing tier under the sliding scale program will pay a flat fee of $25, with no additional charges.
  • If you qualify for a partial fee reduction, your final service fee will be adjusted based on verified income.
  • The $25 minimum charge is included in the total cost and is not an additional charge.

By proceeding with payment or requesting a reduced-cost service, you acknowledge that you have reviewed and agreed to the fee structure.


3. Refund & Cancellation Policy

  • If a correctional facility denies the request, a partial refund will be issued minus the $25 processing fee.
  • No refunds will be provided for:
    • Approved services where the stream was successfully facilitated.
    • Technical issues beyond our control (e.g., facility network restrictions, internet outages, or third-party failures).
    • Requests canceled by the applicant after facility approval.

All services will be provided by VUERZ or another third-party provider, and any refund or dispute regarding service quality, technical issues, or non-delivery must be directed to VUERZ or the applicable service provider, not Compassionate Reprieve.

By submitting a request, you acknowledge that all refunds are subject to the terms above.


4. Income Verification & Attestation

To qualify for reduced-cost services under the sliding scale program:

  • Applicants must complete ID.me verification or provide alternative proof of income as required.
  • Applicants certify that the information provided is true, accurate, and complete to the best of their knowledge.
  • Providing false or misleading information may result in denial of a reduced-cost service, cancellation of requests, or disqualification from future requests.

By applying for a reduced-cost service, you attest that you meet the eligibility criteria and understand that false statements may result in legal consequences.


5. No Liability for Third-Party Service Providers (Including VUERZ)

Compassionate Reprieve is not responsible for, and expressly disclaims liability for, any service or action performed by VUERZ or any other third-party provider, including but not limited to:

  • Technical issues, service failures, or delays caused by funeral homes, correctional facilities, VUERZ, internet service providers, or any other third party.
  • Correctional facility policies or rule changes that may impact the ability to stream services.
  • Errors, negligence, or omissions by VUERZ or any other contracted service provider.
  • Emotional distress, lost opportunity, or other damages resulting from service denial, interruptions, or cancellation.
  • Disputes between the applicant and VUERZ, including refund requests, dissatisfaction with service quality, or non-performance.

All disputes related to the performance, quality, or delivery of streaming services must be directed to VUERZ, the contracted service provider, and not Compassionate Reprieve.

By proceeding, you acknowledge that Compassionate Reprieve acts only as a facilitator and is not responsible for the actions of VUERZ or any third-party service provider.


6. Indemnification & Hold Harmless Clause

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Compassionate Reprieve, its affiliates, officers, directors, employees, agents, and any third-party service providers, including VUERZ, from any claims, losses, liabilities, damages, expenses, or legal actions arising from:

  • Misrepresentation of financial status or eligibility.
  • Service disruptions, denials, or failures outside of Compassionate Reprieve’s control.
  • Any disputes related to services provided by VUERZ or another third-party provider.
  • Any legal claims or damages sought by third parties, including correctional facilities or funeral homes, in connection with the streaming services.

This means you cannot hold Compassionate Reprieve liable for any losses, damages, or service failures related to the use of this service.


7. Data Privacy & Security

  • Compassionate Reprieve does not store, process, or have access to personal financial data. All income verification is handled through ID.me or other third-party verification providers.
  • Payment processing is handled securely by third-party vendors, and Compassionate Reprieve does not store payment details.
  • Any personal data collected will be used only for processing service requests and will not be shared, sold, or retained beyond what is necessary for compliance.

By submitting an application, you consent to the secure processing of your information.


8. Agreement to Terms

By checking the box below and submitting an application or payment, you confirm that:

  • You have read, understood, and agreed to these terms and conditions.
  • You understand the refund policy and eligibility rules under the sliding scale pricing program.
  • You release Compassionate Reprieve, its affiliates, and its third-party service providers, including VUERZ, from all liability related to service performance, denials, and technical issues.
  • You agree that all service-related disputes must be directed to VUERZ or the applicable service provider, not Compassionate Reprieve.
